In order to further clarify the management of cosmetics registration and filing, in accordance with the Cosmetic Supervision and Administration Regulation (hereinafter referred to as the Regulation), the Administrative Measures for Cosmetics Regulation and Notification (hereinafter referred to as the Measures), and the Rules for Registration and Notification Dossiers of Cosmetics (hereinafter referred to as the Rules) and other related regulations, EnterCo has sorted out and summarized some important time nodes and their precautions:
Reporting the safety-related information about cosmetic ingredients
As of January 1, 2023, in case of registration or notification, registration or notification persons shall provide safety-related information of all the ingredients in accordance with the Rules. For the cosmetics with registration or notification already completed, registration or notification persons shall supplement safety-related information of all the ingredients in the product formulation prior to May 1, 2023.
For details of the safety-related information of cosmetic product ingredients, please refer to Annex 12-14 of the Rules.
Evaluation of cosmetics efficacy claims
For cosmetics that have been registered or filed prior to May 1, 2021, the cosmetics registration persons or notification persons shall evaluate the efficacy claims of cosmetics prior to May 1, 2023, in accordance with the Standard for the Evaluation of Efficacy Claims of Cosmetics, and upload the summary of efficacy claims basis.
Efficacy evaluation and test report of cosmetics
For the cosmetics for spot correcting, whitening, and preventing hair loss with the application submitted and registration completed prior to May 1, 2021, registration persons shall submit the human efficacy test report prior to May 1, 2023.
Administration of Cosmetics Labels
As of May 1, 2022, cosmetics applying for registration or filing must comply with the Measures; Cosmetics that apply for registration or filing prior to May 1, 2022, are not labeled and marked in accordance with the Measures, and the cosmetic registrant and filer must complete the update of the product label prior to May 1, 2023, to make it comply with the Measures.
Cosmetic safety assessment report
As of January 1, 2022, cosmetic registrants and filers must conduct cosmetic safety assessments and submit product safety assessment documents in accordance with the Technical Guidance for the Safety Evaluation of Cosmetics (2021 Edition) (hereinafter referred to as the Technical Guidance)before applying for the special cosmetic registration or general cosmetic notification. The Technical Guidelines provide examples of full and simplified versions of cosmetic product safety assessment reports. As of May 1, 2024, cosmetic registrants or filers shall submit a simplified version of the product safety assessment report. After that, the newly registered products need to submit a full version of the safety assessment report.
In addition, the cosmetics filer shall submit the annual report of general cosmetics through the new registration and filing platform from January 1st to March 31st of each year.
