3. Can the person in charge of quality and safety serve concurrently in different cosmetic registrants, filing applicants, and entrusted production enterprises?
According to the FAQs on Cosmetics Production and Operation (1) issued by NMPA, in order to ensure the quality and safety of cosmetics and ensure that the person in charge of quality and safety implements the responsibilities of product quality and safety management and product release in accordance with the law, when applying for more than two (including two) cosmetic production licenses, the same natural person shall not be the person in charge of safety and quality of the above-mentioned enterprise in accordance with the principle of "one certificate for one person". According to the Rules for Registration and Notification Dossiers of Cosmetics, those who have multiple identities such as domestic registrants or filing persons, domestic responsible persons, and production enterprises, or the same domestic responsible person corresponds to multiple overseas registrants and filing persons, can submit all relevant materials at one time and obtain corresponding user rights. Existing users can supplement relevant materials according to the situation, so as to increase user rights.
Domestic cosmetic enterprises that only engage in entrusted production should open an account in the name of "production enterprises" in order to confirm the entrusted production relationship.
5. Do the dossiers related to cosmetic user information need to be stamped with seals page by page?
According to Article 5 of the Rules for Registration and Notification Dossiers of Cosmetics, the cosmetic registration and filing dossiers shall comply with the relevant national regulations on the use of seals, and have complete signatures and seals with legal effect. If an overseas enterprise or organization does not use the seal, it shall be signed by the legal representative or the person in charge of the enterprise (organization).
