FAQs on the Filing Application Form of General Cosmetics

1. How to fill in the classification code in the filing application form?

According to Article 27 (2) of the Rules for Registration and Notification Dossiers of Cosmetics, the registrant and the filing applicant shall determine the product category and the corresponding product classification code in accordance with the Regulations for the Supervision and Administration of Cosmetics and Classification Rules and Classification Catalogue of Cosmetics. If the efficacy of special cosmetics is claimed, it shall be declared as special cosmetics.


In addition, according to Article 10 of the Classification Rules and Classification Catalogue of Cosmetics, cosmetics that contain two or more independent formulas which must be used together or whose packaging containers cannot be separated shall be classified and coded as one product.


2. Which sites of action in the classification code are easy to be confused?

(1) "Head" and "hair". According to the description of the classification catalogue of the site of action in Table 2 of the Classification Rules and Classification Catalogue of Cosmetics, hair dye and hair perm products can only correspond to this site of action (hair), UV protection products can not correspond to this site of action; head: does not include the face. Therefore, if the label of a shampoo claims to "nourish the scalp and hair", the site of action of the classification code in the filing application form should select 04 head.


(2) "Face", "body" and "the whole body skin". According to the description of the classification catalogue of the site of action in Table 2 of the Classification Rules and Classification Catalogue of Cosmetics, the face: does not include lips and eyes; the body: does not include face, hand and foot; the whole body skin: does not include lip and eyes. Therefore, if the application method in cosmetic labels is "apply to the face and neck", the site of action of the classification code in the filing application form should select "03 body/05 face" instead of "09 the whole body skin".


3. What is the difference between the user group "infants" and "children" in the classification code?

According to the provisions of the classification catalogue of the user group in Table 3 of the Classification Rules and Classification Catalogue of Cosmetics, "infants" are 0-3 years old, including 3 years old. The efficacy claims of products involving this group of people are limited to cleansing, moisturizing, hair care, sun protection, soothing, and refreshing. "Children" are 3-12 years old, including 12 years old. The efficacy claims of products involving this group of people are limited to cleansing, makeup remover, moisturizing, beauty modification, fragrance, hair care, sun protection, repair, soothing, and refreshing. Therefore, if a children's cosmetic claims to have a "repair" efficacy, the user group can only select "02 children".


4. Which product dosage forms in the classification code are easy to be confused?

(1) "Gel" and "paste, mask, substrate". According to the provisions of the classification catalogue of the product dosage form in Table 4 of the Classification Rules and Classification Catalogue of Cosmetics, "gel" refers to jelly, glue, etc., "paste, mask, substrate" refers to paste, mask, containing substrates used with cosmetics. Therefore, if a sleeping facial mask is in a gel state and there is no mask-forming step in the production process, the product dosage form in the classification code of the filing application form should select "03 gel" instead of "10 paste, mask, substrate".


(2) "Spray" and "aerosol". According to the provisions of the classification catalogue of the product dosage form in Table 4 of the Classification Rules and Classification Catalogue of Cosmetics, "Spray" does not contain propellant, and "aerosol" contains propellant. Therefore, if a spray product formula contains propane, butane, isopropane and other propellants, the product dosage form in the classification code of the filing application form should select "09 aerosol".
